These General Terms and Conditions of Use govern access to and use of the MaditSpirit website, account area, AI Coach, Skills, dashboards, diagnostic tools, coaching-related features, subscription services and other online features made available by EV-Adworks under the MaditSpirit brand.
They apply to visitors, registered users and customers using the website or platform.
Sales and subscription-specific terms are set out in the Terms and Conditions of Sale. The Privacy Policy explains how personal data is processed.
EV-Adworks operates MaditSpirit under the commercial brand MaditSpirit. The seller information currently published on the website remains applicable. Contact: support@maditspirit.com.
MaditSpirit may be accessed using a compatible internet connection, browser and device. The user is responsible for suitable equipment, software and internet access.
MaditSpirit aims to keep the website and platform available, but temporary interruptions may occur because of maintenance, updates, security measures, provider outages or events outside MaditSpirit’s reasonable control.
A feature may be changed, improved, suspended or discontinued where reasonably necessary. Where a change materially affects a paid service, the applicable sales terms and mandatory consumer rights continue to apply.
Certain features require an account. The user must provide accurate, current information and update it when it changes.
Login credentials are personal. The user must keep them confidential, use a strong password and promptly notify MaditSpirit of suspected unauthorised access.
The user must not create an account using another person’s identity, share credentials, access another person’s account or bypass technical access controls.
MaditSpirit provides digital wellness, lifestyle, educational and personal-development tools. Depending on the selected service, these may include AI-assisted conversations, Skills relating to weight management, sleep, nutrition, emotions, sport and performance, personalised dashboards, diagnostic tools, plans, tasks, routines, logs, educational content, optional add-ons, subscriptions and customer Support.
MaditSpirit offers both Standard Plans and Progressive Pricing Plans. The exact features and access rights depend on the Offer, Plan, duration, order and access rights displayed before purchase.
MaditSpirit’s AI and coaching features provide general wellness, lifestyle, educational and organisational guidance. They are not medical diagnosis, medical treatment, emergency care, psychotherapy or a substitute for a qualified healthcare professional.
AI-generated information may be incomplete, inaccurate, unsuitable or outdated. The user must exercise judgment and obtain qualified professional advice where appropriate. In an emergency, contact the appropriate emergency service.
MaditSpirit does not guarantee a particular health, weight, fitness, sleep, emotional or performance result.
The user remains responsible for messages, goals, logs, questionnaire answers and other material submitted through the platform. The user must provide information honestly and must not submit unlawful, abusive, fraudulent or malicious material.
To provide the service, the user grants MaditSpirit the limited right to host, reproduce, transmit, analyse and otherwise process submitted content as necessary to operate the requested service, provide personalised features, maintain security, resolve Support requests and comply with law. This does not transfer ownership of the user’s personal data or original content.
The user must not use the platform for unlawful purposes, submit malware, disrupt the service, scrape or systematically extract content, resell access without permission, impersonate another person, generate unlawful or abusive material, use the platform to provide medical diagnosis to another person, or place unreasonable load on the website.
MaditSpirit may depend on third-party hosting, payment, email, AI, analytics, authentication and infrastructure providers. Those providers may have their own terms and privacy information.
A third-party link does not mean MaditSpirit controls or endorses that website. MaditSpirit is not responsible for third-party content, products or services except where mandatory law provides otherwise.
The MaditSpirit website, software, design, branding, text, graphics, databases, AI prompts, workflows, original educational content and platform features are protected by intellectual-property laws.
Subject to payment and compliance with the applicable terms, MaditSpirit grants a limited, personal, non-exclusive, non-transferable and revocable right to use the relevant service for personal purposes. The user must not copy, publish, sell, distribute, reproduce, modify, reverse-engineer or commercially exploit MaditSpirit materials except where permitted by law or authorised in writing.
MaditSpirit may restrict or suspend access where reasonably necessary because of non-payment, suspected fraud or account compromise, unlawful or abusive use, material breach, a legal or security requirement, or a technical emergency.
Where appropriate, MaditSpirit will provide notice and an opportunity to remedy the issue. Suspension or termination does not remove rights or obligations accrued before it.
MaditSpirit is responsible for providing its services with the care required by applicable law. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights.
To the extent permitted by law, MaditSpirit is not responsible for interruptions caused by third-party infrastructure or events outside its reasonable control, loss caused by inaccurate information supplied by the user, the user’s failure to follow reasonable instructions or seek professional advice, or third-party websites and services.
MaditSpirit may update these Terms to reflect legal, security, technical or service changes. The version applicable to a particular use or order is the version displayed or accepted at the relevant time, subject to mandatory law.
These Terms are governed by French law, subject to mandatory consumer-protection rules that apply in the consumer’s country of residence. MaditSpirit is intended for English-speaking countries and territories where the relevant service and checkout are made available.
A consumer may benefit from rights that cannot be excluded by a choice-of-law clause. Any dispute may be brought before a competent court under applicable law.
These Terms are written in English. Mandatory consumer rights remain unaffected.
